Terms of Service Policy

This policy sets out the terms under which we (“Serjeants LLP”) allow access to our website (www.serjeants.co.uk) (the “website”).  Please read the policy carefully before you start to use the website. By using the website, you accept the terms of the policy and agree to abide by them.

1. Temporary access

Your access to the website is permitted on a temporary basis and we reserve the right to withdraw or amend the service we provide on our website without notice. We will not be liable if you cannot access the website at any time.

Intellectual property (IP) is a complex area of law. You therefore should not rely on any of the information on the website. Such information is provided only as general background and is not intended to constitute legal advice. We therefore disclaim all liability and responsibility arising from any reliance that you may place on such information or any website content.

Although we aim to update the information on the website regularly, the information may be out of date at any particular time.  We are not obliged to keep such information or any website content up to date.

The information or any other content on the website is provided without any guarantees, conditions or warranties as to its accuracy. To the extent permitted by law, we expressly exclude the following:

    • wasted management or office time, and

    • any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable, provided that this condition shall not prevent claims for loss of or damage to your tangible property or any other claims for direct financial loss that are not excluded by any of the categories set out above.  

This does not affect our liability for death or personal injury arising from our negligence nor our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter nor any other liability which cannot be excluded or limited under applicable law.  

4. Intellectual property rights

We own all of the intellectual property (IP) rights in the website and its content, which is protected by copyright. All such IP rights are reserved.  You may print off one copy, and may download extracts, of any page(s) from the website for your personal reference.  You may not make any commercial use of any such printed pages or downloaded extracts. If you print off, copy or download any part of the website in breach of these terms, your right to use the website will cease immediately.  We will also insist that you return or destroy any printed pages, copies or downloaded extracts.

5. Viruses, hacking and other offences  

You must not misuse the website by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to the website, the server on which the website is stored, or any server, computer or database connected to the website. You must not attack the website via a denial-of-service attack or a distributed denial-of service attack.  By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach your right to use the website will cease immediately.  

We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the website or to your downloading of any material posted on it or on any website linked to it.

6. Links from the website  

Where the website contains links to other websites and resources provided by third parties, such links are provided for your information only. We have no control over the contents of those websites or resources and accept no responsibility for them or for any loss or damage that may arise from your use of them.  

7. Applicable law and jurisdiction

This policy shall be governed and construed according to the laws of England and Wales and the courts of England and Wales shall have exclusive jurisdiction over any claim arising from or related to a visit to website; although we retain the right to bring proceedings against you for breach of this policy in your country of residence or any other relevant country. 

8. Variations  

We may revise this policy at any time. You are expected to check the policy from time to time to take notice of any changes made as they are binding on you. Some of the terms in this policy may also be superseded by provisions or notices published elsewhere on the website.
